General Terms of Sale
Buy a work
Each work presented on the Site is accompanied by a complete description of its characteristics, price, geographical location and delivery costs at the buyer’s expense. To acquire a work, simply place it in its basket (“Acquire”), confirm its order (“Finish my order”) and pay the price (“Payment”).
In the event that the work is no longer available, an email will be sent to the buyer within 48 hours resulting in the cancellation of the order, and the full refund of the transaction.
Sales contract
Line Up Gallery acts as a simple intermediary in the sole context of making the Site available allowing the connection of sellers and buyers.
As a result, Line Up Gallery is not a party to the sales contract, which is only between the Buyer and the Seller, who is the sole seller of the Works and is solely bound by the obligations that flow from them.
Disposal of copyright
In the event of the acquisition of one of his works by a client of the Site, the Artist yields to the purchaser, without limitation of duration, the support of the work under consideration, as well as all the heritage rights attached to it, namely the right of representation and reproduction in the framework defined below, in accordance with the provisions of Article L. 122-7 of the Intellectual Property Code. , and to retain only his moral rights. The purchaser will be able to exhibit the work in any place of his choice, present it to the public, including to a relocated public, sell it, lend it or rent it.
The Seller, however, retains the moral right to the work sold as well as the rights related to its reproduction.
Price of works
The sale price of the Works is displayed on the Site in the currency determined by the Buyer and includes all taxes, except for delivery and packaging fees if applicable.
The different possible delivery methods and associated costs are indicated at the time of the summary of the order. The cost of delivery and packaging depends on the nature of the work, its size, its weight, as well as the place of delivery.
Payment media
The transfer of ownership occurs once the full price is paid by the Buyer. In case of non-payment of the entire price, the sale will be automatically cancelled, and the work will be put up for sale on the Line Up Gallery website.
Delivery of works
The delivery time in the territory of metropolitan France is no more than 60 days from the validation of the regulation for the benefit of the Site. This maximum delivery time is increased to 90 days for any other location. Delivery is made at the address indicated by the buyer on the purchase order, during business hours.
Delivery costs and ancillary costs depend on the nature of the work, its size of clutter, its weight and the place of delivery.
Reserve
The buyer is obliged, upon receipt, to unpack and check the condition of the work in the presence of the carrier and to issue all reservations that he deems useful to the latter, in writing and without delay, and no later than 48 hours by email to: contact@lineupgallery.com.
Any product that has not been the subject of reservations communicated by recommended letter with request for notice of receipt within 3 days of its receipt to the carrier, in accordance with Article L. 133-3 of the Code of Commerce, and of which copy will be addressed simultaneously to the Site, will be considered accepted by the customer.
Authenticity of the works
The works sold on the Site are all original. A certificate of authenticity issued by the Artist, author of the work, will be given to the buyer.
If they are limited edition works, they are reproduced in a quantity in accordance with the applicable rules and regularly numbered.
Right of retraction
Under Article L.121-21 (Consumer Act of 17 March 2014) of the Consumer Code, the Buyer has 14 days from the delivery of the Work to implement its right of withdrawal to the Seller, without charge and without cause.
The Buyer exercises his right of withdrawal to Line Up Gallery by sending an email to the following address contact@lineupgallery.com.
Line Up Gallery will then make its case for the Buyer’s request for retraction and proceed with its refund within 14 days of the date on which Line Up Gallery was informed of the exercise of the Buyer’s right of withdrawal.
The refund will cover the price of the work paid by the Buyer as well as the return fee.
Works returned damaged or soiled by the Buyer will not be taken back or refunded, as Line Up Gallery reserves this choice at its sole discretion.
Tax benefits for businesses
Under the terms of theArticle 238 bis AB of the General Tax Code, companies that purchase original works by living artists and register them in a locked-in asset account may deduct from the result of the acquisition exercise and the following four years, in equal fractions, an amount equal to the purchase price.
The deduction for each fiscal year may not exceed the limit mentioned in the first paragraph of theArticle 238 bis (i.e. a tax reduction equal to 60 of the amount of payments, taken within 5 per cent of turnover), minus the total payments mentioned in the same item.
The benefit of this deduction is conditional on the company’s compliance with the obligation to exhibit the work in a place accessible to the public or its employees, with the exception of their offices, for the period corresponding to the acquisition exercise and the following four years.
Editorial information
The Site broadcasts various editorial content (articles, files, practical information, etc.) produced by the Site. These content and services are only available for informational purposes. While the Company undertakes to implement all the means at its disposal to provide Users with quality content and services, it does not guarantee the completeness, accuracy or updating of such content and services.
Hyperlink and cookies
A ‘cookie’ allows the site user to be identified, the site’s visit personalized and the site’s display accelerated by recording a data file on their computer. The user acknowledges that he is aware of this practice and authorizes www.lineupgallery.com to use it.
The Site undertakes never to communicate the contents of these ‘cookies’ to third parties, except in the event of a legal requisition. The user can refuse to register ‘cookies’ or set up his browser to be notified before the ‘cookies’ are accepted. To do this, the user will set up his browser.
Personal data protection
Line Up Gallery collects and retains the personal data of the Buyer and Seller for the proper execution of these.
In according The Computer Science Act 78-17 of January 6, 1978, To individual files and freedoms, the Buyer has the right to access, modify, correct and delete personal data processed via the Site at the time of the order, as well as the right to object to the disclosure of this data to third parties for just reasons by making a request to the following address: contact@lineupgallery.com
Personal data provided by the Buyer will be destroyed no later than six months after the Purchase account is deleted.
Line Up Gallery reserves the right to retain certain data in order to justify, if necessary, the perfect performance of its contractual or legal obligations. The data thus stored will be limited to what is strictly necessary for the operation of the service.
Line Up Gallery is committed to putting all measures in place to best protect the confidentiality of the information provided by the Buyer and seller.
Applicable law – skills
These terms and conditions of sale are governed by French law.
Mediation
In the event of a dispute, the Purchaser has the right to appeal to a consumer mediator for the amicable resolution of any dispute relating to the performance of these CGVs, as provided for in articles L.611-1 and following articles as well as R.612-1 and following of the Consumer Code.
